Advanced Texas Lien and Payment continues where the Texas Lien Law class leaves off. The session explores what happens if a lien is filed and it takes a lawsuit and judgment to enforce it. Understanding the process of determining if and how much of your debt will be paid and the likelihood of recovery is important in determining how to proceed with a lawsuit to enforce a lien claim. This class also discusses the issue of whether you can continue with efforts to secure your lien if your customer files for bankruptcy or will you end up violating the automatic stay. This class also discusses a special issue of removables in Texas which gives certain parties a powerful right over other creditors. Other topics discussed are important elements of a joint check agreement as well as the Texas Construction Trust Fund Act. This course is conveniently presented on the same day as the Texas Lien Law class by the same Texas Board Certified Construction Lawyer.
